1. Identification of the Responsible Party

This document sets forth the Terms of Use for the Astrology App digital platform, operated by:

Hereinafter referred to simply as “Astrology App”, “We”, or “the Company”.

Although headquartered in Australia, Astrology App offers its services globally and complies with consumer protection and data protection legislation applicable in each jurisdiction where its users are located, including, as applicable, the Australian Consumer Law (ACL), the Brazilian General Data Protection Law (LGPD — Law No. 13,709/2018), the European Union General Data Protection Regulation (GDPR), and other relevant local legislation.

2. Acceptance of Terms

By accessing, browsing, or using Astrology App in any of its versions (web or mobile application), the user declares that they have read, understood, and fully agree to these Terms of Use and the Privacy Policy.

If the user does not agree with any provision of these Terms, they must immediately cease using the platform.

These Terms constitute a legally binding agreement between the user and Nowalls Analytics Pty Ltd.

3. Eligibility and Minimum Age

The use of Astrology App is intended exclusively for persons with a minimum age of:

• 18 (eighteen) years, as a general rule;
• 16 (sixteen) years, when duly assisted by a legal representative, in jurisdictions that so permit (including Brazil, pursuant to the LGPD, Art. 14);
• 13 (thirteen) years, in jurisdictions where this is the applicable minimum legal age, always with verifiable parental consent.

Children under 13 (thirteen) years of age are not authorized to use the platform under any circumstances. If we become aware that data from minors who do not meet the applicable minimum age has been collected, such data will be promptly deleted.

By using the service, the user declares and warrants that they meet the eligibility requirements applicable in their jurisdiction.

4. Service Description

Astrology App is a digital platform that offers astrological calculations based on astronomical ephemerides (Swiss Ephemeris) and interpretations generated by artificial intelligence. The service includes, but is not limited to:

• Natal chart, synastry, solar return, and planetary transit calculations;
• Personalized interpretations generated by artificial intelligence;
• Weekly horoscope based on real astronomical transits;
• Premium content unlockable through the use of tokens.

5. Nature of Content and Professional Disclaimer

IMPORTANT: All content provided by Astrology App is intended solely for entertainment and self-discovery purposes. The generated content:

• Does not constitute, under any circumstances, medical, psychological, financial, legal, or any other professional advice;
• Should not be used as the sole basis for making personal, professional, financial, or health decisions;
• Is generated by artificial intelligence and may therefore contain inaccuracies, generalizations, or interpretations that do not reflect the complexity of the user’s individual situation;
• Does not replace, under any circumstances, consultation with qualified professionals in the relevant fields.

Astrology App is not responsible for decisions or actions that the user may take based on interpretations generated by the platform.

6. AI-Generated Content

The user acknowledges and agrees that the astrological interpretations provided by Astrology App are generated by third-party artificial intelligence (AI) models, and that:

• AI responses are generated automatically and are not individually reviewed by human professionals;
• AI may generate content that is inaccurate, incomplete, repetitive, or that does not reflect the official position of the company;
• Astrology App does not guarantee the accuracy, reliability, or suitability of any generated content;
• Generated content does not reflect a human professional opinion or personalized advice from a certified astrologer;
• The user has the right to request a review of decisions or content generated exclusively by automated means, as provided by applicable legislation (including Article 20 of the LGPD for users in Brazil and Article 22 of the GDPR for users in the European Union).

7. User Account

To use the features of Astrology App, the user must create a personal account, providing truthful, complete, and up-to-date information. The user is fully responsible for:

• Maintaining the confidentiality of their login credentials;
• All activities conducted through their account;
• Immediately notifying Astrology App in the event of unauthorized use or suspected security breach.

Astrology App reserves the right to suspend or terminate accounts that violate these Terms, with prior notice whenever reasonable, except in cases of fraud or threats to the platform’s security.

8. Tokens and Payments

8.1. Nature of Tokens

Tokens are the virtual currency used within Astrology App to unlock premium content. Tokens:

• Are purchased through payment methods made available on the platform;
• Have no monetary value outside the application;
• Are non-transferable between accounts;
• Cannot be converted into cash or any other asset.

8.2. Refund and Right of Withdrawal

a) General Rule (Australian Consumer Law): Consumer refund rights under the Australian Consumer Law apply to all purchases. If the service suffers a major failure, the user is entitled to a full refund. For minor failures, Astrology App will rectify the issue within a reasonable timeframe.

b) Users in Brazil: In accordance with Article 49 of the Consumer Protection Code (Law No. 8,078/1990), users located in Brazil may exercise the right of withdrawal within 7 (seven) calendar days from the date of purchase, provided that the purchased tokens have not been used, in whole or in part.

c) Users in the European Union: In accordance with Directive 2011/83/EU, users in the EU have a 14 (fourteen) day right of withdrawal, unless the digital content has already been accessed with express consent and waiver of the right of withdrawal.

d) To request a refund, the user should contact us at support@astrologyapp.net.

8.3. Technical Failures

Tokens consumed to unlock content that could not be accessed due to a verified technical failure will be restored (in tokens or as a refund, at the user’s choice). The user must report the issue within 72 (seventy-two) hours of occurrence.

8.4. Payment Processing

Payments are processed by third-party platforms (Stripe). Astrology App does not store credit or debit card data on its own servers.

8.5. Price Changes

We reserve the right to change token prices at any time. Changes will not affect tokens already purchased and will be communicated in advance on the platform.

9. Acceptable Use

The user agrees to use Astrology App ethically, lawfully, and in compliance with these Terms. The following activities are expressly prohibited:

• Providing false or fictitious birth data;
• Using the platform for illegal, fraudulent, or harmful purposes;
• Attempting to access other users’ accounts;
• Using bots, scrapers, or automated tools to access the service;
• Reproducing, distributing, sublicensing, or commercializing generated content without prior express authorization;
• Reverse engineering, decompiling, or attempting to access the platform’s source code;
• Intentionally overloading the servers or service infrastructure;
• Presenting content generated by Astrology App as if it were authored by the user, by another professional, or by any source other than Astrology App;
• Removing, concealing, or altering any trademark, logo, attribution, or reference to Astrology App from the generated content;
• Using generated content to provide paid professional services to third parties (including, but not limited to, astrological consultations, coaching, holistic therapies, advisory, or any professional activity) without a prior express commercial license from Nowalls Analytics Pty Ltd.

9.1. Entry of Third-Party Data

The user who enters third-party birth data on the platform declares and warrants that:

• They have obtained the free, informed, and express consent of the person whose data is being entered, prior to entry;
• They have informed the third party that their data will be processed by Astrology App, including submission to artificial intelligence providers, as described in the Privacy Policy;
• They assume full civil and legal responsibility for the entry of third-party data without proper consent;
• They understand that entering third-party data without consent may constitute a violation of applicable data protection legislation (including the LGPD, the GDPR, and the Australian Privacy Act), subjecting the user to the penalties provided by law.

Astrology App reserves the right to suspend or terminate the account of any user who is proven to have entered third-party data without proper consent.

10. Intellectual Property and Content Use License

10.1.

All design, source code, trademarks, logos, algorithms, texts, images, and other elements that comprise Astrology App are the exclusive property of Nowalls Analytics Pty Ltd and are protected by Australian law, international intellectual property treaties, and applicable legislation in each jurisdiction.

10.2. Personal Use License

Astrological interpretations generated specifically for the user are granted under a personal, non-transferable, non-exclusive, and revocable license, exclusively for personal and private use. This license allows the user to:

• View and consult the generated content for their own use;
• Share excerpts of the content on social media for personal and non-commercial purposes, provided that attribution to Astrology App remains visible;
• Print the content for personal and private use, provided that attribution to Astrology App is maintained.

10.3. Express Restrictions

The license granted in clause 10.2 does NOT authorize the user to:

• Use generated content for commercial or professional purposes, including resale, paid redistribution, or provision of services to third parties;
• Present the content as if it were authored by the user, by another professional, or by any source other than Astrology App;
• Remove, alter, or conceal attribution to Astrology App, its trademarks, or references in any generated content, whether in digital or printed format;
• Generate content using third-party data for the purpose of resale, consulting, or service provision, even if free of charge, without a commercial license;
• Reproduce, compile, or aggregate generated content to create databases, publications, or derivative materials for distribution.

10.4. Commercial License

Professionals, businesses, or entities wishing to use Astrology App for commercial purposes (including, but not limited to, professional astrological consultations, content generation for clients, integration into proprietary services, or resale of interpretations) must obtain a prior commercial license from Nowalls Analytics Pty Ltd by contacting support@astrologyapp.net. Commercial use without a license constitutes a violation of these Terms and of applicable intellectual property legislation, subjecting the offender to appropriate legal measures.

10.5.

The reproduction, distribution, modification, or commercial use of any platform content without prior express written authorization from Nowalls Analytics Pty Ltd is prohibited.

11. Service Availability

Astrology App will use its best efforts to maintain the platform available on a continuous basis. However, the user acknowledges that the service may be temporarily interrupted for:

• Scheduled or emergency maintenance;
• System or feature updates;
• Force majeure or fortuitous events;
• Technical problems with third-party infrastructure (servers, APIs, AI providers).

Astrology App shall not be liable for any losses arising from temporary service unavailability, to the fullest extent permitted by applicable law.

12. Changes to the Service

Astrology App reserves the right, at any time, to:

• Modify, add, or remove features;
• Change the interface, design, or user experience;
• Discontinue the service or part thereof, with a minimum of 30 (thirty) days’ prior notice to active users.

In the event of total discontinuation of the service, unused tokens will be refunded proportionally.

13. Limitation of Liability

13.1.

Astrology App is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, except those that cannot be legally excluded (including warranties provided under the Australian Consumer Law, the Brazilian Consumer Protection Code, and other applicable consumer protection legislation).

13.2.

To the fullest extent permitted by applicable law, Astrology App shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages;
• Loss of data, lost profits, or business interruption;
• Decisions made by the user based on content generated by the platform;
• Failures of third-party services integrated into the platform (Stripe, Firebase, AI APIs, Resend);
• Inaccuracies in astrological interpretations generated by artificial intelligence.

13.3.

In any event, the total liability of Astrology App to the user shall be limited to the amount actually paid by the user in the 12 (twelve) months preceding the event giving rise to the claim, except where local legislation does not permit such limitation.

13.4. Notice for Users in Australia

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. The consumer is entitled to a replacement or refund for a major failure and to compensation for any other reasonably foreseeable loss or damage. The consumer is also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

14. Account Cancellation and Deletion

14.1.

The user may request the cancellation of their account and the deletion of their personal data at any time through the application settings or by emailing support@astrologyapp.net.

14.2.

Upon cancellation request:

• Refund rights for unused tokens will be assessed in accordance with clause 8.2 and applicable legislation in the user’s jurisdiction;
• Access to previously generated content will be terminated;
• Personal data will be deleted within 30 (thirty) days, except for data that must be retained due to legal or regulatory obligations.

14.3.

Astrology App may terminate the user’s account, with prior notice when reasonable, in the event of a violation of these Terms, fraudulent use, or any conduct that compromises the security or integrity of the platform.

15. Modifications to These Terms

Astrology App reserves the right to modify these Terms of Use at any time. Changes will be communicated to the user through:

• Email notification to the registered email address;
• Push notification or in-app banner;
• Update of the “last updated” date on this page.

Substantial changes will take effect 15 (fifteen) days after notification. Continued use of the service after this period will be considered acceptance of the new terms. If the user does not agree with the changes, they must cease using the platform and, if desired, request the deletion of their account.

16. Applicable Law and Dispute Resolution

16.1.

These Terms of Use are primarily governed by the laws of the State of Queensland, Australia, without prejudice to mandatory consumer protection and data protection rules applicable in the user’s jurisdiction.

16.2.

For users in Australia, the parties submit to the exclusive jurisdiction of the courts of Queensland, Australia.

16.3.

For users in Brazil, nothing in these Terms shall prejudice the consumer’s right to bring action against Astrology App before the courts of their domicile, pursuant to Article 101, item I, of the Consumer Protection Code (Law No. 8,078/1990). The rights provided by the Consumer Protection Code and the LGPD are fully guaranteed.

16.4.

For users in the European Union, nothing in these Terms shall prejudice the consumer’s inalienable rights under the legislation of their country of residence, including the GDPR and European consumer protection directives.

16.5.

The parties shall endeavor to resolve any disputes amicably before resorting to any judicial or arbitral proceedings.

17. General Provisions

17.1.

Any tolerance or failure to exercise any right under these Terms shall not constitute a waiver or novation and may be exercised at any time.

17.2.

If any clause of these Terms is deemed invalid or unenforceable by a competent authority, the remaining provisions shall remain in full force and effect.

17.3.

These Terms constitute the entire agreement between the user and Astrology App regarding the use of the platform, superseding any prior understandings or agreements on the same subject matter.

17.4.

Nothing in these Terms is intended to exclude, restrict, or modify rights that the consumer may have under mandatory legislation that cannot be contractually excluded.
